These Terms of Service ("Terms") are a binding agreement between you and StoresWiki LLC ("we", "us"), Lewes, Delaware, USA, and govern your access to and use of Autogineer Cloud (the "Service"). By creating an account, clicking "I agree", or using the Service, you accept these Terms. If you do not agree, do not use the Service. Last updated 10 July 2026.

1. Definitions

"Server" means a virtual private server (Linux container) you provision through the Service. "Content" means any data, code, or material you store, run, or transmit using a Server. "Plan" means the resource tier (vCPU, memory, disk, bandwidth) you select. "Order" means a purchase of a Plan for a billing term.

2. The Service

Autogineer Cloud provides on-demand virtual private servers and optional one-click application and operating-system images. Servers are isolated Linux containers on our managed infrastructure. We manage the underlying host, network, and hypervisor; you manage everything inside your Server: the operating system, packages, applications, data, and security.

We may add, change, or discontinue features, images, and Plans. We will give reasonable notice of material changes that adversely affect an active paid Plan.

3. Eligibility & accounts

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. You must provide accurate registration details, verify your email, and keep your credentials confidential. You are responsible for all activity under your account and for the root password you set on each Server. Notify us immediately of any unauthorized use.

4. Acceptable use & prohibited hosting

Your use of the Service must at all times comply with our Acceptable Use Policy and Fair Usage Policy, which are incorporated into these Terms. Without limiting those policies, the following are strictly prohibited on any Server:

Content that is unlawful under the laws of the United States, the European Union, or the jurisdiction of your end users, including child sexual abuse material (CSAM), which is reported to the competent authorities without notice.

Malware, ransomware, spyware, botnet command-and-control, exploit kits, phishing pages, or credential-harvesting sites.

Unsolicited bulk email (spam), snowshoe spamming, list-washing, or operating an open SMTP relay. Outbound port 25 is closed by default on customer servers.

Unauthorized cryptocurrency mining, hash-rental, or proof-of-work workloads, and 'free-VPS'-style resource reselling that exists mainly to consume CPU.

Network abuse: port scanning, DoS/DDoS (as source or reflector), traffic amplification, brute-forcing, ARP/DNS spoofing, or unauthorized penetration of systems you do not own.

Anonymous or high-risk proxying / VPN exit / TOR exit relays operated to launder third-party traffic, and open proxies.

Fraud, carding, fake-document services, pill/pharma spam storefronts, and money-laundering infrastructure.

Content that infringes intellectual property (piracy, warez, unlicensed streaming) or violates a third party's privacy.

Adult content that is illegal, non-consensual, or fails to meet mandatory age-verification and record-keeping requirements.

Hate speech, incitement to violence, terrorist content, or the sale of weapons/controlled substances.

We reserve the right to determine, in our reasonable judgment, whether Content or activity violates this section.

5. Your responsibilities & backups

You are responsible for keeping your Server's operating system and software patched, for configuring firewalls and access controls, for the legality of your Content, and for compliance with laws applicable to you and your end users (including data-protection and consumer laws).

The Service is not a backup service. You are responsible for maintaining your own independent backups of any important data. We are not liable for data loss.

6. Billing, terms & taxes

Paid Plans are billed through our payment processor (Stripe). Monthly Plans are billed in advance and renew automatically each month until cancelled. Multi-month terms (12, 24, or 48 months) are charged once, upfront, for the whole term and expire at the end of that term unless you place a new Order.

Prices are exclusive of taxes unless stated; you are responsible for any applicable VAT or sales tax. Server resources are reserved for you on provisioning, so fees are generally non-refundable except as stated in our Refund Policy. You authorize us to charge your payment method for all fees, renewals, and applicable taxes.

7. Suspension & termination — reasons

We may suspend or terminate a Server or your account, with or without prior notice depending on severity, for any of the following reasons:

(a) non-payment or a failed/expired subscription; (b) violation of these Terms, the Acceptable Use Policy, or the Fair Usage Policy; (c) hosting prohibited content listed in section 4; (d) confirmed malware, phishing, or a compromised Server actively attacking or spamming others; (e) sustained resource or bandwidth abuse that degrades the platform or other customers; (f) a valid legal order, abuse complaint, or law-enforcement request; (g) chargeback or suspected payment fraud; (h) risk to the security, integrity, or reputation of the platform.

For severe issues (active attacks, CSAM, malware distribution, network abuse) we may suspend immediately to protect the platform and third parties. For lesser issues we will normally notify you and give an opportunity to remedy where practical.

8. Data retention after suspension

If a subscription lapses or a Server is suspended for a remediable reason, we retain its data for a 7-day grace period during which you can reactivate. After the grace period the Server and its data may be permanently deleted. Servers terminated for serious abuse or illegal content may be deleted without a grace period.

9. Security scanning

To protect the platform and our customers, we operate automated, host-side security and malware scanning of Server storage and monitor network patterns for abuse. We do not routinely inspect the substance of your Content, but we may access it where necessary to investigate a suspected violation, respond to a legal request, or resolve a technical issue. Detected malware may be reported to you and, where required, to the relevant authorities.

10. Availability & warranty disclaimer

We aim for high availability but do not guarantee uninterrupted or error-free service. Except as expressly stated, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, to the fullest extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, StoresWiki LLC shall not be liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill. Our aggregate liability arising from the Service is limited to the amounts you paid us in the three (3) months preceding the event giving rise to the claim. Nothing limits liability that cannot be excluded by law.

12. Indemnity

You agree to indemnify and hold harmless StoresWiki LLC and its personnel from claims, losses, and expenses (including reasonable legal fees) arising from your Content, your use of the Service, or your breach of these Terms.

13. Changes & governing law

We may update these Terms; material changes will be posted here with a revised date and, where appropriate, notified by email. Continued use after changes take effect constitutes acceptance. These Terms are governed by the laws of the State of Delaware, USA, and the state and federal courts located in Delaware, USA have exclusive jurisdiction, subject to any mandatory consumer-protection rights in your country of residence.
